The ChallengeWe are looking for a Contract Claims Attorney to join the NC Department of Justice in our Raleigh headquarters. The NC Department of Justice represents the State of North Carolina in court and provides legal advice and representation to most state government departments agencies officers and commissions. The Department also represents the State in criminal appeals from state trial courts and brings legal actions on behalf of the state and its citizens when the public interest is at stake. In this role you will Represent and advise the NC Turnpike Authority on all legal questions in the complex areas of transportation agency law and complex contract issues. Work closely with and advise on a daily basis senior level client officials who review develop and implement state federal legislative requirements and policy goals on federal state statutes regulations and case law affecting the entire transportation program. Negotiate complex specialized contractual agreements with private companies including private consultants that are typically represented by teams of highly specialized and experienced counsel. Independently review and advise the Turnpike Authority and senior Department officials regarding legislative matters affecting the Department s program or policies. Represent and advise the Turnpike Authority in matters relating to procurement condemnation and financing of Turnpikes. Coordinate with and supervise outside legal services and provide advice concerning public-private partnerships and drafts reviews documents for such purposes. Independently represent and advise the Turnpike Authority in diverse areas of law including environmental law toll collection issues tort liability law financing and contract law. Advise on real property law issues for right of way purposes. Many of these are issues of first impression. Represent the Turnpike Authority in negotiations and transactions involving US Army Corps of Engineers the NC Wildlife commission and local governments. Function as in-house counsel to private companies who may have a team of specialized attorneys. Perform transactional work involving governmental business construction and real estate law. Advise the Turnpike Authority staff on other legal topics including insurance law environmental law employment law debtor-creditor bankruptcy law and intellectual property law (specifically software licensing and copyright infringement issues). Engage in litigation regarding toll appeals. Frequently serve as witness counsel to Turnpike Authority and other Department employees in litigation between private parties. Participate in the Division s criminal brief rotation schedule. What You BringConsiderable knowledge of case statutory regulatory common law civil procedure and the rules of evidence. Ability to conduct civil litigation in state and appellate courts. Highly developed skills analyzing facts and evidence interpreting and applying statutes regulations and case law developing creative case strategy and tactics and expressing legal arguments and conclusions clearly concisely and convincingly both orally and in writing. Ability to establish and maintain effective working relationships with NCDOT employees at all levels the judiciary lawyers and co-workers. Management PrefersCandidates with experience with complex commercial transactions general or in-house counsel and administrative law.
